Rape of 12 year old dismissed as "hormones gone wild"

    MARTINEZ (KRON) -- A 14-year old boy accused of raping a 12-year old girl in the stairwell of Portola Middle School will not be tried as an adult.

    Contra Costa County prosecutors say they made the decision to bring juvenile rape and false imprisonment charges against the boy based on his age, the circumstances of the crime, his level of sophistication,.. and the chances he could be rehabilitated by the age of 18.

    At the request of the boy's attorney, a hearing on whether the young man will be held in custody or released to his parents has been delayed until Thursday afternoon.

    Administrators have suspended the principal and vice-principal of Portola Middle School while they investigate security at the campus.

    The decision to charge the child as a juvenile comes on the same day as comments from a school site supervisor saying the alleged sexual assault shouldn't be considered a rape.

    "They're calling it a rape when it wasn't really a rape," Portola Middle School Site Supervisor Mustapha Cannon told reporters Tuesday morning. "When this is all over with I want to see if I can get a public apology for my principal, who is my friend, and my vice-..principal, who is my friend who aren't at work right now. Some kids are not as popular as other kids. You have a girl that's not as popular as some of the girls. You have a guy who is not as popular with some of the guys and the girls. It was hormones gone wild. There's been plenty of incidents that happened that haven't been reported as possible rapes or attempted rapes. I think this is something that's been worded the wrong way."

    Cannon says it's his opinion that the intercourse was consensual.

    "They probably just took it too far and embarrassment kicked in," the site supervisor said. "As far as calling it a rape, I think it's something that they did together and it got worded the wrong way. When the kids came up, it was an embarrassment type thing, and then the parents got in, but as for calling it a rape, I wouldn't word it like that."

    Cannon says he knows of other similar incidents on campus.

    "These are kids with hormones raging," he added. "There's touching, there's slapping on the bottoms. This particular case just went too far, they took it too far."

    A West Contra Costa School District spokesperson is refusing to comment on Cannon's statements.

    Some parents say they're angry at the school because they weren't notified of the incident and subsequent arrest. Other parents say they did receive an automated phone notification last week.

    Police and prosecutors say they do believe there's enough evidence to proceed with the criminal case against the 14-year old boy.

    I don't think he should be tried as an adult - he is not. If the girl was like 5 or 7 or something, then maybe, but there was only a two year age gap. It is believable that it was consensual; there are tons of girls who cry rape when they actually consented and regretted it later and those poor guys are labeled as sex offenders forever. Plus, if I remember correctly, the average age kids lose their virginity goes down every year. Not saying this is the case, but there is really no way to know. Unfortunately, there is only one side to the story so far (just read what you posted, not sure if there is more somewhere else).
    I think both kids should go to councelling, maybe a shrink could get the truth out and if it was rape, and if it was get both of them emotional help.
    I don't understand what being popular has to do with sex and rape, either, but oh well. Attorneys like to bring up whatever they can I guess.

    To further your post KnockitBack, I wouldn't be surprised if this were consensual at all, the age for EVERYTHING is going down, I know ten year olds that are dealing pot and twelve year olds who are practically pimps.

    This is a myth. Rape is an underreported crime, not an overreported one. Only 8% of rape claims brought to court are ruled to be unfounded. Considering how difficult it is to prove that rape took place in a court of law, we can assume the actual incidence of false rape claims is even lower.

    and fuck ya i think it was most likly consetual and ya i started smoking pot when i was 10 or 11 so ya this is not that big of a deal to me thay should invesgate it more maybe this kid might still be inoccent

    I know rape is under reported, but think about how many statutory rape claims were pressed from consenting girl's parents who were upset she was fucking around.

    Ok, normally I would agree with you. But I'm just curious... do you not think a 14 year old could be rehabilitated with proper counceling, etc. (assuming he has a sense of remorse)? I'm not trying to excuse rape at all, because if this really was rape that poor girl is going to be traumatized forever, but kids do stupid shit. I know rape isn't your typical stupid teenage shit like stealing or vandalizing or huffing paint, but I don't know... I'd like to give him the benefit of the doubt based on what little information is provided.

    My girlfriends son was in a program that mixed boys and girls in a juvenile hall type setting. He had concensual sex with two different girls in the girls bathroom during class time. There was a harsh punishment threatened for any kind of sexual behaviour. One girl found out about the other one and went to the school counselor with allegations of rape. Well she got in trouble for lying and the other girl got in trouble and my girls son had to register as a sex offender. I'm not excusing his behaviour but it wasn't rape and he still had severe consequences after it was proved she was lying. People jump to conclusions to quickly when it comes to minors.

    I'm 14 myself, and I've seen how fucked up people my age can be. However, I also understand how quick we are to lie our way out of a social fuck-up. It's definately possible that the incident was entirely consentual, and the girl lied to everyone to dodge being labeled a slut due to societies god-awful double standard.. I'm getting a bit off-topic, but it's a little fucked that a male can throw his seed about wildy and be greeted with high-fives and male barbarism later, while a girl sleeps with one guy and she's automatically a helacious whore. I digress.. Males of my age are also capable of commiting such a horrific act without hesitation. It's discusting what today's youth are becoming. I really feel sorry for the kid if he is innocent, but if he's not i wouldn't mind bumping into him in a dark alleyway at night..

    Reminds me of a demotivational poster i saw once, even as (an attempt at) humor the logic behind it pretty much exemplifies the double standard, as well as general views on gender roles that are disturbingly common among some of the people at my school.

    i dont think so personally because i know of people who did that shit at that age, and they just grew up to be pieces of shit. Most people dont have the money for proper counceling, so no, of course there are exceptions to every rule but i wouldnt give him the benefit of the doubt.

    innocent until proven guilty, ever get the feeling they don't know the word of justice.

    and yes he shouldn't be treated as an adult but an impunitive pysch test might not go amiss i'm sure, we can't let kids not be kids, we treat them like the rest of society already, idiots, what do you get....

    school system needs to be rerigged too, dodn't mean to appear insensitive, i am a little detached but rape is never ok!

    every situation is different,i used to work in a place where teenagers went through this stuff.
    first his 14.. not an adult at any age.... if he went to juvenile centre he would become fucked up.
    Fuck it is not fun. when there is a charge they have to see a cop, they are to describe everythiing they can remember.. i mean they even need to use proper words and go through every detail.takes so long to get to court, if either of you have ha an alcohol or drugs... then its fucked and most of the time they gve up.

    So if you are young your parents, friends and even your school will kow... so really in most cases... its not a fun year. you wouldnt do it unless you needed to.

    But some peope regret doing things when they are around 12... but most of the time they are even teh chance to get support even if it wasnt rape but they just felt shitty after it.

    Probably got shit to do with peer pressure if it was at school... they probably both end up changng schools and that school will have a ba reputation for kids fucking at lunch time

    I actually joined this forum for the reason of this post though i am interested in may of the topics i read so far this one really hits home for me. When i was twelve years old we had a group project, our group consisted of me, my best friend since i was two, and my girlfriend at the times best friend. We took this time in my basement working on the project as a chance for early adolescent sexual experimentation. Though it took a little convincing, the girl consented to everything we did with her (which wasnt much being we were 12). After a few weeks she felt so guilty she had to tell my girlfriend she messed around with me but must have bailed out halfway through and told her we made her do it. Through a series of circumstances parents and the school became involved and i was almost a registered sex offender. Being 18 years old now and and anti sexist I look back at my actions that day and see many flaws in the way i acted but it definately wasnt rape. I am not the person i was at 12 or 14 and my views on sex have changed greatly over the years but i also believe its possible for a 14 year old to be guilty of premeditated deliberate rape. Im not sure what i would have the consequences for the kid to be. I dont believe in systemized justice, i do believe in street justice. If a friend of mine was raped, we would round up a small group of trusted friends and beat the living hell maybe even kill the people involved. A person is more likely to lie to authorities than a group of friends based on trust and open communication. Just putting my opinion out there I wouldnt demonize the kid or the girl because i dont trust the news to report anything properly and i dont know the full story
